- Advance Health Directives.
An EPA is a Power of Attorney that operates when the person has lost mental capacity to make decisions. It can be used for:
- Financial and/or
- Health/personal matters
The practice also assists with the administration of deceased estates. Sometimes it is necessary to obtain a Grant of Probate; sometimes other measures suffice eg. transmission of land directly from the deceased to a beneficiary.
Estate disputes are also handled. Where the deceased leaves inadequate provision for family members, certain relatives are entitled to apply to the Court for adequate provision from the estate. This application is called a Testator’s Family Maintenance application (TFM). Time limits apply to a TFM.
